Your Account

To create an account and join us at e.bio, ensure that you are at least 18 years old. If you're creating an account on behalf of someone else, please obtain their permission beforehand. As a user, you hold the responsibility for your account's lawful use.

By creating an account, you consent to abide by our Terms and confirm that you meet the age requirement (18+) and have the legal capacity to enter into this agreement. Your account details must be accurate, and any changes should be promptly communicated to us for updating. If you represent a business or individual on e.bio, you affirm that you have the proper authorization to act and accept these Terms on their behalf. As the account holder, you are solely responsible for all account activities. Keep your login credentials secure, and do not share them with others.

If you suspect any account compromise, please contact us immediately for assistance.

Transferring your account to someone else or using it in a manner that, in our reasonable judgment, harms e.bio, its reputation, or infringes upon the rights of others or applicable laws, is strictly prohibited.

Your username

We understand the significance of your chosen username. It must not only hold personal importance but also align with appropriateness for all users and respect intellectual property rights, including copyright and trademarks.

To maintain a fair and inclusive environment, you cannot use the name of a celebrity, brand, or company, nor select a username that is offensive or inappropriate. Engaging in "Domain Squatting," where you acquire a username without genuine connection for future profit, is strictly prohibited.

Should any of these concerns arise regarding your username, we will assess the situation thoughtfully and may request you to modify it. In certain cases, we might assign the username to someone else. Failure to comply may result in the suspension or termination of your account.

If another party claims that your username infringes their intellectual property rights, they must complete an Intellectual Property report. You will then have the opportunity to issue a Counter Notice.

We value your presence on e.bio, and if there has been no activity on your account for the last 3 months, we may reclaim or reassign your username. Rest assured, we will always contact you before making any changes.

Your content - what is and isn't allowed

At e.bio, we embrace the diverse range of content shared by our users. However, our commitment to ensuring a safe environment for everyone on the Platform drives us to establish our Community Standards.

These Community Standards outline permissible content on e.bio. It is crucial to adhere to them, as failure to comply may result in the suspension or permanent removal of your account.

When referring to "your content," we encompass text, graphics, videos, links, and any other materials added to your e.bio profile. You are responsible for your content and affirm that:

- It belongs to you, or if third-party content is used, you possess all necessary rights to post it on e.bio and permit us to use it in accordance with our Terms.

- Your content does not violate anyone else's privacy, publicity, intellectual property rights, or any other rights.

- It will not mislead or deceive, nor intend to misinform reasonable individuals.

- It will not cause either party to violate laws or legal obligations or damage our reputation.

- It is free from viruses, harmful code, or files designed to disrupt the Platform's functionality or any other software, hardware, or device.

- You will not employ or authorize others to use automated scripts or scraping tools to gather information from your profile or the Platform.

- You will not post unauthorized advertising, solicitations, or endorsements on e.bio.

- All your content complies with our Community Standards.

Due to variations in laws and regulations across countries, content may be banned on e.bio, even if legal in certain regions. We reserve the right to take necessary actions, including removing content or restricting access to it or the Platform.

Your content - what we can do with it

We are thrilled to showcase your amazing content! By posting content on e.bio, you grant us the right to display, use, and share it.

When you share content on your profile, you provide us with a license to publicly display, distribute, modify, adapt, and create derivative works of your content; and use your name, image, voice, photograph, likeness, and other personal attributes in the content on the Platform and in our marketing across all media, including our social channels and advertising. This worldwide, royalty-free, and perpetual license allows us to use your content globally, without any fees, for an indefinite period. You confirm that you possess all necessary third-party rights to post content on e.bio and grant us this license.

Rest assured, you will retain all your rights to your content. However, please be aware that your content will be publicly accessible and may be shared by others on e.bio and the internet.

To protect your privacy, refrain from sharing personal information you don't want visible to the world. Avoid posting sensitive details such as social security numbers or passport information that could be harmful if misused. Only share personal information about others with their consent, and ensure you keep a record of it.

While we are not obligated to monitor the accuracy, reliability, or legality of your content, we may choose to do so. We reserve the right to modify, remove, or restrict access to content at any time in accordance with these Terms. Additionally, we may apply a sensitive content warning to material that we consider unsuitable for all audiences.

Our Platform

As the rightful owners of the e.bio Platform, we grant you a limited, revocable, non-exclusive, non-transferable right to utilize it for content sharing, engaging with other users, and viewing their content. However, we bear no responsibility for any content, products, or services presented on other users' profiles.

All rights, including Intellectual Property Rights, to the e.bio Platform (excluding your content) – referred to as "e.bio IP" – are and will remain exclusively owned by e.bio or our licensors. You shall not acquire any rights in the e.bio IP, and any use, including our brand name or logo, for purposes such as implying partnership or endorsement, requires our prior written consent.

As a user, you are granted the privilege to create, display, use, play, and upload content on the Platform in line with these Terms. If we provide you with images, icons, themes, fonts, videos, graphics, or other content, you must adhere to our guidelines and limit usage to your profile.

Removing, obscuring, or altering proprietary notices or trademarks on the Platform, unauthorized copying, reproducing, distributing, licensing, selling, modifying, translating, disassembling, decompiling, decrypting, reverse engineering, or attempting to derive the source code of the Platform or any part thereof is strictly prohibited. When visiting e.bio profiles as a "profile visitor," you are granted a limited, non-exclusive, non-transferable right to view and interact with the Platform.

To the extent permitted by law, we assume no responsibility for any opinions, advice, statements, products, services, offers, or other content posted by other users on their profiles.

Your plan

You can effortlessly register for an e.bio account, choosing between our free or paid plans, with the flexibility to cancel at your convenience.

Upon accepting these Terms, your plan commences and remains active until you decide to cancel. If you cancel a paid plan, it usually continues until the end of your current billing cycle, transitioning automatically to a free plan.

To cancel, simply visit our billing page (https://ebio.gg/billing). While payments are generally non-refundable according to applicable law, we understand that circumstances may change. If you opt for a paid plan and cancel within 72 hours, exceptions may apply (kindly reach out to [email protected]).

Should you choose to permanently delete your account after canceling your plan, you can do so on your 'Dashboard Account' page (https://ebio.gg/dashboard/deletion). Keep in mind that this action is irreversible, and you will not be able to reactivate your account or retrieve any content or information added to your profile.

Privacy & data

At e.bio, safeguarding the privacy of our esteemed users and Profile Visitors is of utmost importance.

Our Privacy Notice meticulously outlines the handling of your personal data for our internal purposes. Simultaneously, our Data Processing Addendum ("DPA"), which is seamlessly integrated into these Terms, defines your responsibilities (and ours) concerning the privacy rights of visitors to your profile. By creating your account, you expressly agree that, where applicable, you have thoroughly read, comprehended, and consented to the DPA. It is essential to acknowledge that all data, including any intellectual property rights pertaining to the data, generated or created by us or the Platform based on your use, profile visitors' activities, or other users' interactions with the Platform or content ("Data"), shall remain our exclusive ownership.

As part of our service on the Platform, we may furnish Data or Data Analytics to you. While we strive to ensure the accuracy and comprehensiveness of the Data Analytics, we cannot provide guarantees or warranties. Nevertheless, rest assured that we endeavor to offer the most accurate and comprehensive Data Analytics within our capacity.

Your visitors & customers

As an esteemed e.bio user, you assume complete responsibility for your profile visitors, including those who interact with your content.

You are solely accountable for:

- overseeing how End Users utilize and interact with your profile and content on e.bio,

- ensuring compliance with all relevant laws regarding End Users.

Confidentiality

If we share any confidential information about us or the Platform with you, you must keep it secret and secure.

From time to time, we may share info with you that is confidential (e.g. we may reveal new and upcoming features to you if you take part in beta testing with us). You must keep this info secret and secure and use reasonable measures to prevent others from accessing it.

Feedback

At e.bio, we highly value your valuable insights and ideas on how we can enhance our platform. As part of our commitment to constant improvement, we may occasionally introduce "beta" functionality, seeking your valuable feedback.

Kindly note that any feedback you provide us grants e.bio the unrestricted right to utilize it as deemed fit, without the obligation of compensation (or the discretion not to use it). Additionally, we may intermittently offer specific "beta" or similar functionalities on the platform. Please be aware that such beta features are still in the evaluation and testing phase and may not possess the same level of reliability as other components of the platform.

Liability

At e.bio, we emphasize that your use of the Platform is at your own risk, and you are responsible for maintaining backups of your content.

- We cannot be held liable for any damages resulting from the download, installation, or usage of the Platform, or from the copying, distribution, or download of any content on the Platform. It is your sole responsibility to adequately protect and backup your data, content, and devices used in conjunction with the Platform.

- By agreeing to these Terms, you commit to indemnifying us against any loss arising from a breach of these Terms or any third-party claim related to your content.

- Neither party shall be held liable for indirect, punitive, special, incidental, or consequential damages, including but not limited to loss of business, revenue, profits, use, privacy, data, goodwill, or other economic advantages, whether due to breach of contract, negligence, or any other cause, even if the possibility of such damages is known to us.

- In any event, our total liability to you under these Terms or concerning the Platform shall not exceed the greater of the fees you paid to us at the time the liability arose or $100.

Disclaimer

Your usage of e.bio and its content is solely at your own risk. The platform is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied, including up-time, availability, merchantability, fitness for a specific purpose, non-infringement, or course of performance.

Neither e.bio, its affiliates, nor its licensors make any express or implied warranties or representations, including:

- Uninterrupted or secure platform functioning.

- Correction of any errors or defects.

- Virus-free or devoid of harmful components.

- Platform effectiveness or meeting your needs.

- Completeness, accuracy, reliability, suitability, or availability of content on the platform, including user content.

These Terms hold to the maximum extent permitted by law, and nothing within them is meant to exclude, restrict, or modify your legal rights that cannot be excluded, restricted, or modified by contract. If these Terms are governed by the Australian Consumer Law, our liability to you for not adhering to a consumer guarantee is limited to re-supplying the services or payment.

Third Party Services

On e.bio, we may provide access to specific functionalities or services offered by third parties, such as payment portals or online store fronts.

Please note that e.bio integrates with various third-party products and services. It is important to understand that we neither endorse nor make any warranties or representations regarding these third-party offerings. Additionally, e.bio does not offer refunds for any amounts paid to third parties.

When using any third-party product or service, you are bound by their separate terms and conditions. It is your responsibility to review, accept, and comply with those terms. Failure to accept or comply with these third-party terms may result in the suspension or cancellation of your e.bio account or limited access to the services within our platform.

Cancelling your account

In the event of non-compliance with these Terms, we reserve the right to suspend, cancel, or restrict access to your e.bio account or certain Platform functionalities. It is important to note that we may exercise this right without providing specific reasoning, and suspension or cancellation may occur without prior notice.

We strive to maintain a secure and compliant environment, and while we generally aim to inform users of account actions, the discretion to suspend or cancel an account without disclosing the full reasoning remains with us.

For any concerns or disputes, please contact [email protected], and we commit to pursuing resolution in good faith. Legal action will not be pursued until both parties have spent at least one month attempting to resolve the matter amicably.

Changes

As e.bio continues to evolve and improve, we may, on occasion, make modifications to the platform or these Terms. Should a change have a significant adverse impact on you, we will provide prior notification.

Updates to these Terms may be necessary to reflect business developments, platform changes (including potential discontinuation of functionality, features, or parts), legal or commercial requirements, or to safeguard our legitimate interests.

We retain the right to implement these changes at any time, and it is your responsibility to periodically review these Terms for updates. Nevertheless, should a change substantially affect you, we will endeavor to notify you at least 1 month in advance (e.g., via a platform notification).

By continuing to use the platform after any modifications to the Terms, you signify your acceptance of the revised terms. In case of disagreement with the changes, we kindly request you to discontinue using e.bio and cancel your account.

Important Legal Notice

Before you start using e.bio, there are a few essential points we must address.

Depending on your specific location, certain laws may apply to you or us. In case of any inconsistency between these Terms and applicable laws, the latter shall take precedence.

These Terms, together with the Privacy Notice and any linked policies, constitute the entire agreement between you and us concerning the Platform. No additional terms will be included, except where mandated by law. Any implied terms not required by statute are explicitly excluded.

If any provision of these Terms is deemed invalid under the law of any country or the EU, it will be severed from these Terms in that jurisdiction, and the remainder of these Terms will continue to apply.

These Terms are governed by the laws of Germany and the applicable laws of the European Union. Both you and we submit to the exclusive jurisdiction of the German courts.

Our failure to enforce any provision of these Terms will not waive any rights or provisions.

Using e.bio's Music Link or Video Link functions to display YouTube videos means you agree to be bound by the YouTube Terms of Service . Please read them carefully.
